Terms of Use — Crystal AI

Please read these Terms of Use ("Terms") carefully before using the Crystal AI mobile application (the "App") operated by Leander Johannes Kahrens ("we," "our," or "us").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Use of the App

Crystal AI is a crystal identification, healing guide, and spiritual companion application powered by artificial intelligence. The App allows you to:

• Identify crystals using AI-powered photo analysis
• Chat with an AI assistant about crystals, healing, and spiritual practices
• Browse a crystal encyclopedia
• Charge crystals with healing sound frequencies
• Track moon phases and lunar cycles
• Manage your personal crystal collection

You must be at least 13 years old to use the App.

2. Accounts

You may be required to create an account to access certain features. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Providing accurate and current information

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Subscriptions and Payments

3.1 Free Tier

The App offers limited free access including 3 AI chat messages and 3 crystal identifications.

3.2 Crystal AI Premium

Premium subscriptions unlock unlimited access to all features. Subscription options:

• Monthly: $2.99 USD / €2.99 EUR per month
• Yearly: $22.99 USD / €22.99 EUR per year

3.3 Billing

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
• You can manage and cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions).
• Any unused portion of a free trial period, if offered, will be forfeited when you purchase a subscription.
• Prices may vary by region and are subject to change. Any price changes will take effect at the start of the next billing period following notice.

3.4 Refunds

Refund requests are handled by Apple in accordance with their refund policies. We do not process refunds directly. To request a refund, visit https://reportaproblem.apple.com .

4. Health and Medical Disclaimer

CRYSTAL AI DOES NOT PROVIDE MEDICAL ADVICE.

All information provided by the App regarding crystal healing, chakras, energy work, and related spiritual practices is for educational and entertainment purposes only. This information:

• Is not intended to diagnose, treat, cure, or prevent any disease or medical condition
• Should not be used as a substitute for professional medical advice, diagnosis, or treatment
• Is based on traditional and metaphysical beliefs that are not scientifically verified
• Should not replace consultation with qualified healthcare providers

If you are experiencing a medical or mental health emergency, please contact your local emergency services immediately.

Crystal healing is a complementary practice. Always consult a licensed healthcare professional for medical concerns.

5. AI Disclaimer

The App uses artificial intelligence to provide crystal identifications and chat responses. You acknowledge that:

• AI-generated identifications may not always be accurate. Results should be considered suggestions, not definitive identifications.
• AI chat responses are generated by a language model and may occasionally contain errors or inaccuracies.
• AI responses do not constitute professional advice of any kind (medical, legal, financial, or otherwise).
• We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.
• AI responses may vary and are not deterministic — the same question may produce different answers.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to the App or its systems
• Reverse engineer, decompile, or disassemble the App
• Use the App to harass, abuse, or harm others
• Submit false, misleading, or harmful content through the AI chat
• Attempt to circumvent subscription requirements or usage limits
• Use automated tools or scripts to access the App
• Resell, sublicense, or commercially exploit the App or its content

7. Intellectual Property

All content in the App, including but not limited to text, graphics, images, crystal descriptions, icons, audio frequencies, software, and the Crystal AI brand, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from any content in the App without our prior written consent.

Your crystal photos and chat messages remain your property. By using the identification and chat features, you grant us a limited, temporary license to process this content solely for the purpose of providing you with results.

8. User Content

Any content you create within the App (collection notes, custom tags, etc.) remains your property. We do not claim ownership of your user-generated content.

You are solely responsible for any content you submit through the App's AI chat feature.

9. Availability and Modifications

We reserve the right to:

• Modify, suspend, or discontinue any part of the App at any time
• Update these Terms at any time
• Change subscription pricing with reasonable notice
• Add or remove features

We will make reasonable efforts to notify you of material changes. Continued use of the App after changes constitutes acceptance.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

• The App is provided "as is" and "as available" without warranties of any kind, either express or implied.
• We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
• We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
• In no event shall we be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
• Our total liability for all claims related to the App shall not exceed the amount you paid for the App in the 12 months preceding the claim.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation.

11. Indemnification

You agree to indemnify, defend, and hold harmless Crystal AI and its operators from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your violation of these Terms
• Your violation of any third-party rights
• Any content you submit through the App

12. Third-Party Services

The App integrates with third-party services including Firebase (Google), RevenueCat, and OpenRouter/Google Gemini. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices of third-party service providers.

13. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of Germany, without regard to conflict of law provisions.

For consumers residing in the European Union, you retain the benefit of any mandatory provisions of the law of your country of residence.

Any disputes arising from these Terms or the use of the App shall be subject to the exclusive jurisdiction of the courts of Braunschweig, Germany, except where mandatory consumer protection laws provide otherwise.

European consumers may also use the European Commission's Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr .

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Crystal AI regarding the use of the App and supersede any prior agreements.
